Yeah, surprisingly, when I first saw this one, the Upton came out on top vs. the Heiserman. I don't care if one is more period correct than the other, the Upton was smoother in those upper mids.

Right now, many of us are eagerly awaiting the release of mics 251 recreation since everything else he makes is freaking amazing and 1/2 the price! Hi Ward and fellow RGO’s. We are just waiting on the head grille to come back from nickel plating. We have decided to go with BN251 so as not to tread on any toes. Here’s an interesting bit of info for you all; the ELA M 251 has had a trademark challenge applied for in December last year which is pending investigation; I have decided not to be any part of that shemozzle!!! I can’t wait for you all to hear her! Thanks

No not the body style. You can not trademark a physical design if you did not design it in the first place. T funk already have the term Ela M trademarked but this challenge is coming from a much larger entity. It was applied for the same day that the U47 was application was renewed.

So excited about this version as The capsule is the closest I’ve heard yet. I’ve been putting it in all my C12 style mics and it stands up so well to the early 60’s CK12. This is gonna be the winner. Can’t wait , I don’t think I’ve ever been so excited. mics is on fire.

All that I can see is that it was the same few days period when all of the big 5 names were registered or re-registered. I think that there are some interesting times ahead with some squibbling and squabbling to be had. To me it seems a bit ridiculous that anyone can try to hold any trademark over items that were released more than 70 years ago. These entities also realise that they have no legal hold, even if awarded the rights, but what it does do is force open the coffers of anyone who wishes to play ball. In the end, nobody will win and it will likely become free use (I think all of the big 5 will eventually head this way). Doing this will warn off those that don't like a fight and cost the ones that do a ton of loot. just my thoughts.

So “free use” is not exactly “free use?” I can’t imagine there even being a case with it being that long. I thought you had like a ten year period or something to claim trademark violations.

Squabbling isn't good for any business.

I am doubtful they’ll have much success. I’m sure there will be challenges.

My understanding is design patents in USA are good for 17 years, if telefunken never had a patent issued they might be able to get one and that would eliminate copies for 17 years, this is my understanding as a person who went through the process of patenting an article for manufacture, but i am not a lawyer so take my take with a grain
